These Terms of Service (these "Terms") are a legally binding agreement between you and Custie LLC ("Custie," "we," or "us"). Custie is a mobile application platform (available on iOS and Android) that connects pet owners ("Pet Parents") with independent pet service providers (including freelance providers and pet care businesses, collectively "third-party providers"). By accessing or using the Custie app or any related services, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein (collectively, the "Agreement"). If you do not agree with any of these Terms, you must not access or use the Custie platform.
1. Acceptance of Terms
By creating an account or otherwise using Custie, you acknowledge that you have read, understood, and agree to these Terms and all policies incorporated by reference. This includes our Privacy Policy and any other rules or guidelines that we may post. If you do not agree to these Terms, you are not authorized to use Custie. Your use of the platform signifies your acceptance of this Agreement. You represent that you have the legal capacity to enter into this Agreement (i.e., you are of sufficient age and mental competence, and in any event at least 18 years old).
2. Modifications to Terms
Custie reserves the right to modify or update these Terms at any time. Any changes will be effective when posted in the app or on our website (or on the date specified in the update). We may provide notice of material changes, but it is your responsibility to review the Terms periodically. Your continued use of Custie after any modifications are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the platform and, if applicable, cancel any subscriptions or delete your account.
3. User Accounts
To access certain features of Custie (such as booking pet services or offering pet services), you must create a user account. You agree to provide accurate and complete information during registration and to keep your account information up to date. Account types may include Pet Parent accounts for customers, and service provider accounts for freelancers or businesses offering pet care services. Below are important requirements and conditions for user accounts:
- Account Requirement: You must register an account with Custie in order to book services or offer pet-related services through the platform. Each user should create only one account, and you should not share your account with others. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you become aware of any unauthorized access or breach of security, you must notify us immediately. We reserve the right to refuse registration or suspend accounts that violate these Terms.
- Eligibility: Users must be at least 18 years old and reside in the United States to use Custie. By creating an account, you affirm that you are 18 or older and that you are legally permitted to use the platform under applicable law. Custie is intended for U.S. residents; if you access or use the service from another jurisdiction, you are responsible for compliance with local laws.
- Account Verification (Service Providers): If you sign up as a freelance pet service provider or a pet care business on Custie, additional verification steps are required for the safety and trust of our community. Freelance providers must successfully pass a background check conducted by a third-party service (such as Checkr). Pet care businesses (such as grooming salons or boarding facilities) must undergo business verification, which may be facilitated through third-party services like Middesk. By applying as a service provider, you consent to these background or verification checks and agree to provide truthful, necessary information. Custie reserves the right to approve or reject any provider registration based on the results of such checks or other criteria.
- Account Deletion: You may delete your Custie account at any time if you no longer wish to use our services. Account deletion can be done through the in-app settings or by contacting Custie support. Upon account deletion, your profile and personal data will be handled in accordance with our Privacy Policy. Note that certain information (such as transaction records) may be retained as required by law or for legitimate business purposes. Terminating your account will result in the loss of access to the platform's features, and you will not be entitled to any refunds for subscriptions or fees already paid except as outlined in our Refund Policy.
4. Subscription and Payments
Custie operates under a subscription-based Software-as-a-Service (SaaS) model for different types of users, and it facilitates payments for pet service bookings and related products. By subscribing to Custie or making a purchase through the platform, you agree to the pricing, payment, and billing policies as stated in these Terms. All fees are listed in U.S. dollars. If you purchase a subscription or service, you authorize Custie (or our payment processor) to charge your provided payment method for the applicable fees, including recurring subscription fees until you cancel. Below is a breakdown of our subscription offerings and payment terms:
- Pet Parents (Customers): Pet owners using Custie have the option to join the Custie Pet Club membership for a fee of $4.99 per month. This membership is optional and provides special benefits (such as discounts on services or other perks as described in the app). If you choose to subscribe, the membership fee will be billed monthly in advance. Subscriptions automatically renew each month until canceled. You may cancel your Pet Club membership at any time (through your App Store/Play Store subscription management or through Custie if applicable), but no refunds will be provided for the remaining period (see Refund Policy below). After canceling, you will continue to have membership benefits until the end of the current paid month, and the subscription will not renew thereafter.
- Businesses (Pet Care Business Accounts): Pet care businesses (such as salons, daycares, veterinary clinics, or other service providers with physical locations) can use Custie's CRM and platform features for a subscription fee of $29.99 per month per location. Each business location that uses Custie must maintain its own subscription. Business subscriptions are billed monthly and will auto-renew until canceled. Businesses are responsible for ensuring their payment method is up to date. Non-payment of subscription fees may result in suspension of account access or services for that business location.
- Freelance Providers: Independent pet sitters, walkers, or other freelance service providers are not required to pay a monthly subscription fee to use Custie. Instead, Custie earns revenue from freelance provider transactions via a commission model. When a Pet Parent pays for a service booking with a freelance provider, Custie will retain an 18% commission on the service fee as a platform fee. (This means the provider receives 82% of the price, before any applicable taxes or processing fees.) Commission Reductions: This 18% commission may be reduced for providers who are Pet Club members or who achieve certain status tiers on the platform, as part of loyalty or promotional programs. Details of any such commission reductions or tier benefits will be communicated through the app or official policy documents. Freelancers are responsible for any taxes on their earnings and will receive payouts via Stripe (or another payment mechanism Custie provides) after commissions are deducted.
- Payment Processing: Stripe is the exclusive third-party payment processor partnered with Custie for handling all service booking payments and transactions on the platform. When you pay for a service or receive a payout, you agree to comply with Stripe's terms of service and processes. Custie does not store full payment card details; all payments are processed securely by Stripe. We support Apple Pay and Google Pay as payment methods for certain in-app purchases (for example, subscribing to the Pet Club through the app stores). By making a payment on Custie, you authorize Stripe to charge your designated payment method and facilitate the transaction. You also acknowledge that Stripe's processing fees may be included in the charges.
- In-App Purchases & Platform Fees: If you purchase digital goods or subscriptions (such as the Pet Club membership) through the iOS App Store or Google Play Store, please note that such transactions may be subject to the respective platform's terms and fees. The price for in-app purchases may include an additional cost to account for app store commission fees (approximately 15%–30% of the purchase price goes to Apple or Google). These platform fees are beyond Custie's control and are non-refundable once charged (see Refund Policy). When possible, Custie will transparently disclose if a price includes such fees. Any recurring subscriptions set up via Apple or Google will be billed and managed by those platforms, and you may need to use the App Store or Play Store settings to cancel or manage the subscription.
- Authorization and Billing: You agree to pay all fees and applicable taxes incurred by you or anyone using your account. Custie (or the applicable app store) will charge the subscription fees to the payment method you provide. All subscriptions are pre-paid for the applicable subscription period (e.g., monthly) and will automatically renew for successive periods unless you cancel. If your payment method fails or your account is past due, we reserve the right to suspend or revoke access to paid features. You must provide current, valid payment information. In some cases, if a payment fails, we may (but are not obligated to) retry billing at a later time. Custie is not responsible for any fees or charges your bank or card issuer may apply for processing payments.
5. Refund Policy
Custie's refund policy varies depending on the type of transaction (service booking versus subscription) and the circumstances of the request. By making purchases or bookings on Custie, you acknowledge that certain fees are non-refundable as described below. While we strive for customer satisfaction, refunds are not guaranteed. We handle requests on a case-by-case basis in accordance with these Terms:
- Service Bookings (Pet Care Services): Payments for pet care services (e.g., pet sitting, walking, grooming appointments booked through Custie) are typically disbursed to the service provider after the service is completed. Any requests for refunds for services must be directed through Custie's support and will be processed via Stripe, our payment processor. Refunds for services are not guaranteed and will be evaluated on a case-by-case basis. Factors considered may include the circumstances of the request, evidence of service issues or misconduct, and the cancellation policy that was agreed upon at the time of booking. If a service provider fails to deliver the service or if significant issues occur, Custie may, in its discretion, facilitate a refund or credit. However, Custie is primarily a platform connecting users and service providers and does not itself provide the services; thus we do not automatically guarantee refunds for third-party services. Any approved refunds for services will be issued back to the original payment method via Stripe (minus any non-refundable fees outlined below).
- Subscriptions (Membership Fees): Fees paid for subscriptions (such as the Custie Pet Club membership or business account subscriptions) are generally non-refundable. You may cancel a subscription at any time to prevent future charges (for example, cancel before the next monthly billing cycle), but no pro-rated or partial refunds will be given for the current billing period if you decide to stop using the subscription mid-period. After cancellation, you will continue to have access to subscription benefits until the end of the period you've paid for, but you will not receive a refund for any unused time in that period. In rare cases where a billing error occurs or a refund is required by law, we will address those situations as needed. If you subscribed via an app store (Apple App Store or Google Play), any refund requests for those in-app subscription purchases may need to be handled by the respective platform, and their refund policies will apply.
- Platform and Processing Fees: Certain fees associated with transactions are non-refundable once charged. This includes any App Store/Play Store platform fees (the commission these platforms take on in-app purchases) and Stripe payment processing fees that are incurred when a charge is made. For example, if you purchase a membership through the iOS app, Apple may retain a portion of the fee; if you later cancel or seek a refund, that portion cannot be returned by Custie because it was collected by Apple. Similarly, Stripe's processing fees for handling the payment are not returned to us upon a refund, so such amounts cannot be passed back to you. As a result, any refund that is granted for a service or subscription will be net of these third-party fees. We appreciate your understanding that those costs are outside of our control. We encourage users to review service details and subscription terms carefully before making payments.
Note: If you believe you have been billed in error or have extraordinary circumstances, please contact Custie support (see Contact Information below). We value our users and will review your situation in good faith. However, except as explicitly provided in these Terms, all sales and fees are final and non-refundable. Nothing in this Refund Policy affects any rights you may have under consumer protection laws. If required by law in certain jurisdictions, some subscription purchasers may be entitled to a short "cooling-off" cancellation period (e.g., 14 days); if such law applies and you are eligible, Custie will honor such rights as mandated.
6. Intellectual Property
All content and materials on or available through the Custie platform—including but not limited to the mobile application, website, software code, design elements, text, graphics, logos, icons, images, audio/video clips, documentation, and trademarks (collectively, the "Custie Content")—are the property of Custie LLC or its licensors and are protected by United States and international intellectual property laws. Custie and the Custie logo are trademarks/service marks of Custie LLC. All rights, title, and interest in and to the Custie Content and the services (including any software, algorithms, and underlying technology) are reserved by Custie and its licensors.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Custie platform and Custie Content for your personal use (if you are a Pet Parent) or internal business use (if you are a service provider) in accordance with these Terms. You agree not to do any of the following without our express prior written permission:
- Reproduce, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, license, or otherwise exploit any Custie Content (including content downloaded or extracted from the app or website).
- Reverse engineer, decompile, or attempt to extract the source code of any software or component of Custie.
- Use Custie's name, trademarks, logos, or any of the Custie Content for any commercial purpose not expressly permitted by us.
Submitting feedback or suggestions to Custie is entirely voluntary. If you provide us with any feedback, ideas, or suggestions ("Feedback"), you agree that Custie may use such Feedback for any purpose, commercial or otherwise, without any obligation to you. Any user-generated content that you post or submit through Custie (such as reviews, comments, photos, or profile information) remains your property, but by posting it on Custie you grant Custie a worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your content within the platform for the purpose of operating and promoting the service. Please refer to our Privacy Policy for details on how we handle and protect personal data.
Important: You must respect the intellectual property rights of Custie and other users. Unauthorized use of Custie's intellectual property or the platform may result in suspension of your account and potential legal action. If you believe any content on Custie infringes your copyright or other IP rights, please notify us via the Contact Information section below with appropriate details (such notices should comply with the requirements of the Digital Millennium Copyright Act (DMCA) if applicable).
7. Termination
Custie reserves the right to suspend or terminate your account and/or access to the platform at our sole discretion, at any time and without prior notice, under the following circumstances (including but not limited to):
- Violation of Terms or Policies: If you breach or violate any provision of these Terms, the Privacy Policy, or any other policy or guideline applicable to Custie, we may take action to suspend or terminate your access.
- Prohibited or Unlawful Activities: If we suspect that you have engaged in fraudulent, illegal, or unethical activities on the platform (such as fraud, harassment, posting prohibited content, misrepresentation, or harming other users or animals), your account may be immediately terminated.
- Safety or Security Concerns: We may terminate or suspend accounts that pose a risk to the safety of our community, the welfare of pets, or the security of our systems. This includes situations where a service provider fails a background check after initial approval, or where credible complaints have been received about dangerous behavior.
- Legal or Compliance Reasons: If required by law, court order, or government regulation, or if your use of Custie could result in legal liability for Custie, we may terminate your account.
- Inactivity or Other Reasons: We also reserve the right to terminate inactive accounts (for example, accounts not accessed for a prolonged period) or to ban users who repeatedly cancel bookings, receive poor reviews, or otherwise disrupt the platform's normal operations.
If your account is terminated by Custie, you will be notified (either via the app or the email associated with your account) if possible. Termination may be immediate and without prior notice if circumstances warrant. Upon termination, all licenses and rights granted to you in these Terms will cease immediately. You must stop using the app and any Custie Content, and you will lose access to any data associated with your account (except that which we must retain for legal reasons or evidence).
Users who have been terminated by Custie may not create a new account or access the platform without Custie's prior written permission. If you believe your account was suspended or terminated in error, you may contact us to request a review, but Custie's decision in such cases will be final.
User Initiated Termination: You are free to stop using Custie and may delete your account at any time (as described in Section 3). If you delete your account or if it is terminated for any reason, note that you will not be entitled to any refund of any fees (except as explicitly stated otherwise in the Refund Policy).
Even after termination of your account, certain provisions of these Terms will survive and remain in effect. These include, for example, provisions relating to intellectual property ownership, disclaimers of warranties, limitation of liability, dispute resolution, and any other clauses which by their nature are meant to survive termination.
8. Limitation of Liability and Disclaimers
Use of Platform and Third-Party Services
Custie provides a neutral platform that enables connections and transactions between Pet Parents (pet owners) and independent pet service providers (third-party providers). Custie itself does not provide pet care services. The actual agreement for pet care or other services is between the Pet Parent and the service provider. Custie does not have control over, and is not responsible for, the quality, timing, legality, reliability, or any other aspect of the services provided by third-party providers. We do not guarantee the suitability, ability, or performance of any service provider or the outcome of any service. Any issues or disputes regarding a pet service should be resolved between the Pet Parent and the provider. However, Custie may, at its discretion, facilitate communication or conflict resolution, or offer a limited reimbursement under certain conditions (see the "Happy Tail Promise" below).
Third-Party Providers are Independent
All service providers on Custie operate as independent third parties and not as employees, agents, or representatives of Custie. Custie does not direct or control how providers perform their services. We may conduct initial vetting (such as background checks or business verification as described in Section 3) and we may remove or ban providers who violate our standards, but we do not continuously monitor or guarantee any provider's actions. You acknowledge and agree that Custie bears no responsibility for the conduct, actions, or omissions of any Pet Parent or service provider you interact with through our platform, whether online or offline. You should exercise common sense and caution when engaging the services of any third-party provider or when providing services to a pet owner.
No Warranties
Custie and all services and content provided through the platform are offered on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Custie disclaims all warranties, express or implied, in connection with the platform and your use of it. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be error-free, uninterrupted, secure, or will meet your expectations. Custie does not warrant or make any representations regarding the reliability or availability of the platform at any given time or the outcomes of using the service (such as guarantees of successful pet service engagements or the safety of any given provider). You agree that your use of Custie (including any communication and transactions with other users) is at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, Custie LLC and its officers, directors, employees, agents, partners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) Custie or any services booked through Custie. This limitation of liability applies to any damages resulting from (i) your access to, use of, or reliance on Custie or any content therein, (ii) any conduct or content of other users or third parties on or via the platform (including any defamatory, offensive, or illegal conduct of other users or third-party providers), (iii) unauthorized access, use, or alteration of your transmissions or content, or (iv) any other matter relating to the platform or services.
In particular, Custie is not responsible for:
- Personal or Property Damage: Any injury, death, sickness, or property damage that occurs during or as a result of pet services arranged through Custie. (For example, if a pet is injured or a home is damaged during a pet sitting appointment, the liability lies with the individuals involved, not Custie.)
- Financial Loss or Missed Expectations: Any losses arising from transactions between users, including payment disputes or dissatisfaction with services.
- User Conduct: Acts, errors, or omissions of any Pet Parent or service provider, including negligence or willful misconduct.
- Third-Party Products or Services: Issues with third-party tools or services integrated into Custie (for instance, if Stripe's payment system fails or if there are issues with Apple/Google in-app purchases, though we will assist in troubleshooting to the extent we can).
Cap on Liability – "Happy Tail Promise"
If, notwithstanding the above disclaimers, Custie is found to be liable to you for any claim or dispute arising from your use of the platform or services, Custie's aggregate liability to you shall be limited to a maximum of $250.00 USD. This amount includes any remedy that may be provided under Custie's member guarantee program known as the "Happy Tail Promise". The Happy Tail Promise is a voluntary customer care program (available only to active Custie Pet Club members) under which Custie may reimburse a Pet Parent for certain qualifying damages or losses up to $250, at Custie's discretion and subject to program terms. For clarity, $250 is the absolute cap of Custie's liability per user in aggregate, and is not in addition to any other remedy. If you are not a member eligible for the Happy Tail Promise, or if your situation does not fall under that program's guidelines, this liability cap still applies as the maximum total amount Custie could be responsible for. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you to the extent prohibited by law. However, in such cases, our liability will be limited to the smallest amount permitted by applicable law.
Indemnification
You agree that you will indemnify, defend, and hold harmless Custie and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) that arise from (a) your misuse of the platform or services, (b) your violation of these Terms or any applicable law, or (c) your infringement of any third-party right (including intellectual property or privacy rights). We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which event you will cooperate with us in asserting any available defenses).
No Liability for Service Interruptions
While we strive to keep Custie safe and functioning, we cannot guarantee continuous or secure access to our services. Routine maintenance, updates, or technical issues beyond our control (such as internet outages or platform outages) may result in temporary service interruptions. Custie will not be liable for any losses or inconvenience caused by such downtime.
You acknowledge and understand that the disclaimers and limitations of liability in this Section are a fundamental part of this Agreement, and Custie would not be able to provide the platform and services without such protections.
9. Governing Law and Dispute Resolution
Governing Law
This Agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, USA, and (to the extent not inconsistent) the federal laws of the United States. This choice of law applies no matter where you live or use Custie, without regard to conflict of law principles that would cause the application of any other jurisdiction's laws. You agree that the Uniform Computer Information Transactions Act (UCITA), if otherwise applicable, shall not apply to this Agreement.
Arbitration Agreement
By using Custie, you and Custie LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Custie platform shall be resolved through binding arbitration on an individual basis, rather than in court. This includes any claims you may have against Custie, its affiliates, or their respective officers, directors, and employees. You and Custie are each waiving the right to a trial by jury or to participate in a class action.
Key terms of this arbitration agreement are as follows:
- Arbitration Procedure: The arbitration will be administered by a recognized arbitration organization such as the American Arbitration Association (AAA) (or a similar reputable ADR provider agreed upon by both parties) in accordance with that organization's rules applicable to consumer disputes. If AAA is used, the arbitration shall be conducted under the Consumer Arbitration Rules then in effect. You may obtain information about AAA and its rules at www.adr.org or by calling AAA. If for any reason AAA is unavailable or unwilling to handle the dispute, the parties shall agree on an alternative arbitral forum or, if no agreement is reached, a court may appoint an arbitrator pursuant to 9 U.S.C. § 5.
- Arbitration Location and Governing Law: The arbitration shall take place in Dallas, Texas, unless otherwise mutually agreed by you and Custie. You may choose to have the arbitration conducted by telephone, video conference, or based on written submissions if in-person hearing in Dallas would be overly burdensome relative to the amount in dispute. The arbitrator will apply Texas law (as set forth in the Governing Law section above) to the merits of any dispute or claim. The Federal Arbitration Act (FAA) will govern the interpretation and enforcement of this arbitration agreement.
- Individual Basis Only: All arbitrations shall be conducted on an individual basis only, and not on a class, collective, consolidated, or representative basis. The arbitrator shall have no authority to hear or decide any class, collective, or representative action. You acknowledge that this class action waiver is material and essential to the arbitration of any disputes between the parties and is non-severable from the agreement to arbitrate claims.
- Exceptions – Small Claims and Injunctive Relief: Notwithstanding the above, either party retains the right to seek resolution of a claim in a small claims court of competent jurisdiction if the claim is within the court's jurisdictional limits and the court permits such proceedings (for example, for individual claims that do not exceed the small claims dollar limit). Additionally, Custie reserves the right to seek injunctive or other equitable relief in a court of competent jurisdiction (located in Dallas, Texas) to prevent actual or threatened infringement, misappropriation, or violation of our intellectual property rights or proprietary rights. Such an action shall not be deemed incompatible with the agreement to arbitrate or as a waiver of that right.
- Arbitration Process and Fees: To begin an arbitration proceeding, you must send a written request to Custie's mailing address provided in the Contact Information section, describing your claim and indicating your intent to commence arbitration. The arbitration filing fee and other costs shall be shared as per the rules of the arbitration administrator (for example, under AAA Consumer Rules, consumers often pay a limited filing fee and the company pays the remainder of administrative fees). Each party is responsible for their own attorneys' fees and other expenses, unless the arbitrator rules otherwise or applicable law provides for fee-shifting. The arbitrator may award any relief on an individual basis that a court of law could, including individual damages and injunctions, but may only do so in favor of the claimant and not others.
- Confidentiality: The arbitration proceedings, including any rulings, decisions, or awards by the arbitrator, shall be confidential and not disclosed to any third party except as required by law or to enforce the award.
- 30-Day Opt-Out Right: You have the right to opt out of this arbitration agreement if you do not wish to be bound by it. To do so, you must send a written notice of your decision to opt out to our Contact Address (Section 10) within 30 days of first accepting these Terms (or, if this section is a material change from a prior version of the Terms, within 30 days of when that change was communicated to you). The opt-out notice must include your name, address, the email and username associated with your Custie account (if any), and a clear statement that you want to opt out of the arbitration agreement. If you opt out, then notwithstanding the rest of this Section 9, disputes will be resolved in court as provided below. If you do not opt out within the 30-day period, you will be bound by this arbitration agreement.
Forum Selection (Judicial)
If for any reason a claim proceeds in court rather than arbitration (for example, if you opt out of arbitration, if a court determines the arbitration agreement is unenforceable, or if a claim qualifies under one of the above exceptions), then such claim shall be brought exclusively in the state or federal courts located in Dallas County, Texas. You and Custie both consent to the personal jurisdiction of those courts and waive any objection on grounds of venue or inconvenient forum. By agreeing to these Terms, you also waive any right to a jury trial in a court proceeding (this does not apply to the extent such waiver is prohibited by law).
Time Limit on Claims
To the extent permitted by law, any dispute or claim arising out of or related to use of the Custie platform or these Terms must be filed within one (1) year after such claim arose; if it is not filed within that time, the claim is permanently barred. This time limitation does not apply to claims by Custie for unpaid fees or misuse of intellectual property.
You acknowledge that you have read and understood this Governing Law and Dispute Resolution section. By agreeing to these Terms, you affirmatively consent to arbitration and to the class action waiver provided above. You understand that you are giving up certain rights to litigate disputes in court or to participate in class proceedings.
10. Contact Information
